Payments Have Been Issued

Please be advised that settlement payments for the CDS Privacy Breach Class Action have now been distributed to all eligible claimants.

How was I paid? Payments were issued based on the preference you selected during the claims process.

E-transfers: Digital payments were sent to the email address provided on your claim form. Please check your inbox and your "Junk/Spam" folders for a notification from Interac.
Cheques: Physical cheques were mailed via Canada Post to the mailing address on file. Please allow 7-10 business days for mail delivery.

How Your Compensation Was Calculated

Payments have been calculated in accordance with the Award Grid approved by the Court (see below):

Sample Calculation:

A class member who was approved for Low Harm would receive a payment for $43.75. Calculated as $35 (Low Harm award) + $8.75 (25% increase for use of unpaid funds for categories A, B, E & F) = $43.75.

Summary of the Class Action:

You may have received the Notice because a settlement has been approved by the Court of King’s Bench (Manitoba) in a certified class action lawsuit on behalf of individuals whose information appeared in or was attached to an email sent by staff at Manitoba Children's DisABILITY Services ("CDS") on August 26, 2020 to approximately 100 unintended recipients. CDS is operated by the Government of Manitoba
As a person whose information was contained in the August 26, 2020 email (or the parent/guardian of that person), you could be eligible to make a claim for compensation.
All claims must have been submitted before September 25, 2023. If you did not make a claim by September 25, 2023, you would not be eligible for any compensation as part of this lawsuit.
This lawsuit is against the Government of Manitoba as a legal entity, not CDS. Making a claim under the Settlement will not impact the services you receive from Children's DisABILITY Services (CDS) or the Manitoba Department of Families.
